This document, the "Terms of Service", is a legal agreement between you ("you" or "your") and TWiSTSoft® ("we", "us" or "our") in relation to our applications and games that are made available via the App Store, Google Play and/or other app stores (collectively "Marketplace") and all related services (together the "Software").
You agree that your use of the Software constitutes acknowledgement that you have read the Terms of Service ("Agreement"), you understand them, and you agree to be bound by these terms and conditions.
You agree that you are at least 13 years old and that if you are between 13 years and 18 years old, your legal guardian has reviewed and agrees to these terms and is happy for you to use the Software.
We grant you a non-exclusive and non-transferable license to use the Software in accordance with the terms and conditions listed here. The Software is for your personal use only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Any use of the Software in violation of this provision is prohibited.

The Software may contain links to websites operated by third parties, including through in-App advertisements. We do not monitor or control the linked sites and make no representations regarding, and are not liable or responsible for the accuracy, completeness, timeliness, reliability or availability of, any of the content uploaded, displayed, or distributed, or products, or services available at these sites. If you choose to access any third-party site, you do so at your own risk. When you provide data to such third parties you are providing it in accordance with their privacy policy (if any) and our own privacy policy does not apply in relation to that data.
The presence of a link to a third-party site does not constitute or imply our endorsement, sponsorship, or recommendation of the third party or of the content, products, or services contained on, or available through, the third-party site.
We reserve the right to disable links from or to third-party sites.
THE SOFTWARE IS PROVIDED BY US ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL IMPLIED WARRANTIES.
You acknowledge and agree that we make no warranty or condition of any kind, either express or implied, statutory or otherwise, with respect to the Software including, but not limited to, the implied warranties or conditions of merchantability and fitness for a particular purpose and that the user assumes the entire risk as to the use and performance of the Software.
In no event shall we and/or our affiliated and related companies, and their officers, directors and agents be liable to the user or any other person for any direct, indirect, special, consequential or incidental damages (including without limitation, damages for loss of revenues or profits, business interruption, loss of business information, and the like) arising out of the use or inability to use the Software, including any viruses or other problems of any nature or kind whatsoever, all of which such risks the user voluntarily assumes.
In no event will our liability to you, whether in contract, tort (including negligence), or otherwise, exceed the amount paid by you for Software under this Agreement.
You understand that we may update the Software at any time, but our under no obligation to inform you of or furnish to you any such updates. This Agreement does not grant you any right, license or interest in or to any support, maintenance, improvements, modifications, enhancements or updates to the Software or supporting documentation. If we supply any updates to you, such updates will be subject to the terms of this Agreement unless indicated otherwise.
This Agreement is effective from the first date You install the Software. You may terminate this Agreement at any time by permanently deleting, destroying, and returning, at Your own costs, the Software, all backup copies, and all related materials provided by us. Your end-user rights automatically and immediately terminate without notice from us if You fail to comply with any provision of this Agreement. In such an event, You must immediately delete, destroy, or return at Your own cost, the Software, all backup copies, and all related material to us.
We reserve the right to update these terms from time to time by posting the updated version on our website. We may do so because we change the nature of our products or services, for technical or legal reasons, or because the needs of our business have changed. You agree that if you do not accept any amendment to our terms then you shall immediately stop accessing and/or using our Software.
